Abstract
Arbeitsunfälle. Eine Forschungsnotiz In den meisten Studien über Arbeitsunfälle werden diese als Gegebenheit begriffen, deren Ursache es zu finden gilt. Die Ursachen selbst erscheinen häufig als unmittelbare Gegebenheiten in bezug auf Arbeitssituation und Eigenschaften der Opfer. Wie jedoch ein Blick auf die Rechtsgeschichte zeigt, stellt bereits die Definition des Arbeitsunfalls eine Art ökonomisch-ideologischen Einsatz innerhalb der Klassenkämpfe dar. Somit heißt der Forschungsgegenstand in diesem Bereich die Produktion der gesellschaftlichen Definition des Unfalls, von der aus statistisch und juridisch die «Arbeitsunfälle» konstituiert und beriicksichtigt werden.Industrial accidents : a note for future research Most studies deal with industrial accidents as a datum for which they seek the causes, these causes being more often than not immediate data relating to the actual working situation or to the properties of the victim. But, as legal history reminds us, the very definition of the industrial accident is an economic and ideological crux in the context of the class struggle. Therefore, a study in this particular field would start off by focussing on the ways and means whereby industrial accident legislation was established as a social factor, and would then look at the way in which «industrial accidents» are constituted and accounted for as far as statistics and the Law are concerned.Les accidents du travail. La plupart des études prennent l'accident du travail comme un donné dont elles cherchent les causes, ces causes étant le plus souvent des données immédiates relatives à la situation de travail ou aux propriétés des victimes. Mais, comme le rappelle l'histoire du droit, la définition même de l'accident du travail est un enjeu économique et idéologique de la lutte entre les classes. Aussi une recherche en ce domaine consiste à prendre comme objet la production de la définition sociale de l'accident à partir de laquelle sont constitués et pris en compte, statistiquement et juridiquement, les «accidents du travail».Lenoir Rémi.
