Nursing Home Patients' Rights: Are They Enforceable?

Abstract
The nursing home patients' bill of rights now found in federal Medicare and Medicaid regulations reflects public concern that the personal liberties of institutionalized elderly are often denied. The regulations provide for enforcement by: first, the nursing home administrator; and second, the governmental certification process. In addition, courts are beginning to permit enforcement litigation by nursing home residents; however, this remedy is not generally available. The solution proposed is a citation system of monetary penalties for violations of patients rights.Keywords
