On Kith and Kine (and Crustaceans): Trade and Environment in the EU and WTO

Abstract
This chapter is about cattle and their calves, particularly recent controversies regarding the manner in which these animals are reared, as well as the quality of the meat which they produce. The theme of the chapter is international trade and environment, with the latter being broadly conceived to include animal welfare and public health issues. Issues surrounding the export of live veal calves in the European Union (EU) are examined in the context of the trade/environment debate in international law. The approach of the General Agreement on Tariffs and Trade (GATT) and the World Trade Organisation (WTO) to this controversy is discussed in the context of the recent shrimp reports of a GATT panel and WTO Appellate Body. The second case study considers the EU's ‘hormones’ regime and its associated prohibition on the importation of beef from cattle to which hormones have been administered for fattening purposes.Keywords
