The Evolution of Asylum in France

Abstract
The rights of asylum seekers in France have suffered from the administration's tendency to treat them under the heading of immigration and the lack of debate on asylum as a separate issue. This article describes current asylum procedures, relating to at-port and in-country applications for recognition as a refugee or for territorial asylum. The Socialist Party's pre-election proposals on asylum are compared with its measures in government, in the law of 11 May 1998 (territorial asylum, constitutional asylum, extension of accelerated ‘fast-track’ procedures), and subsequent regulations (conditions of access to detention zones by NGOs, accommodation for asylum seekers, increase in their allowances). Four areas in particular are examined: access to French territory for the purpose of claiming asylum; the procedure for claiming recognition as a refugee; territorial asylum; and the determination of refugee status.
