Abstract
Men who develop otosclerosis after enlisting in one of the Services and are later exposed to gunfire or excessive noise which gives rise to additional hearing loss may have their appeal for a pension rejected on the grounds of the High Court of Justice decision in theUnsworth case of 1950. In this so-called ‘signpost’ case it was maintained that otosclerosis cannot be caused or aggravated by war service conditions. The contention is made that the additional deafness caused by acoustic trauma increases the disability so that some compensation is justifiable. The acceptance of this point could have far reaching effects upon the outcome of some Pension Appeals.Keywords
