Abstract
This chapter challenges the view that the primacy of individual rights represents the individual's perspective or interest against the public good or against the claims, demands, needs, or requirements of others generally. A major theme discussed is that the image of right as a safeguard of the right-holder's interest against the claim of others distorts the nature of the concepts and its role in one's thought. The protection of rights is traditionally one of the central tasks of the courts. Therefore, the courts have a central role to play in the politics of the common good.
