Legal Issues and the Handicapped Infant: From Policy to Reality

Abstract
PL 94-142, the Education for Handicapped Children Act (EHA), was designed to ensure appropriate educational services for all handicapped children ages 3 through 21. As states use this legislation in developing regulations to serve handicapped infants birth through 2, confusing and discrepant practices are occurring to the detriment of the handicapped infant. While the effort of these states to provide services to infants is commendable, EHA regulations may be inappropriate because of the unique nature and needs of infants.
